Association debt collector Pro Solutions must not be too happy now that a federal judge has rejected its claim for $14,744 in collection costs levied on a Santa Rosa homeowner.
The dispute over Pro Solutions collection costs arose during a bankruptcy proceeding.
Filing for Chapter 13, Santa Rose homeowner Antonio Cisneros readily agreed to pay off the assessment debt on his two condominiums and collection costs that were actually incurred.
But he balked at paying the $14,744 in miscellaneous fees claimed by Pro Solutions, an assessment debt collector hired by Land Smith Business Homeowners' Association.
Federal Judge Alan Jaroslovsky sided with Cisneros, writing in his ruling that "Even if the court were to find that Pro Solutions' charges were allowable under state law, the court would still not allow (them) because the court is not convinced that they are reasonable." He declared the charges to be arbitrary.
Jaroslovsky's analysis was that "Pro Solutions fees are unreasonable and excessive and not recoverable. . .because the association did not actually incur those costs (claimed by Pro Solutions.)
The Cisneros case should give hope to homeowners battling the outrageous fees levied by association debt collectors, since the courts up to this point have been reluctant to restrain the costs or to find them "unreasonable."
The court documents state that "Pro Solutions is a debt collection/foreclosure company owned by Janet Quinn Dennis, a non-lawyer. She employs 19 people, none of whom is licensed to practice law. The company is based in Pittsburg, California (Contra Costa County.)
Pro Solutions is well-known to the Center for California Homeowner Association Law, since homeowners have lodged dozens of complaints with CCHAL against this debt collector. Homeowners complain about its sky-high collection costs and also the so-called "payment plans" that Pro Solutions coerces them into.
As a condition of getting a payment plan, Pro Solutions demands that homeowners waive their consumer protection rights under Civil Code 1367.1 requiring a debt collector to apply the payments FIRST to assessments and, only after they are paid down in full, to collection costs.
Refusing to comply with Civil Code 1367.1 means debt collectors like Pro Solutions can keep charging collection costs, because the foundation for collection fees -- the assessments -- is being paid down slowly, if at all. Such plans increase the likelihood that the assessment debt will reach the $1800 threshold that triggers a foreclosure sale.

Обьясняю для бестолковых - почему нужна федеральная программа в защиту домовладельцев. Если у вас что-то случается с финансами - заболели, лишились работы, ребенок пошел в колледж, кто-то умер, - короче, всякое может случится - то от моргичной компании вы еще кое-как можете открутиться, договориться и т.д. От Ассоциации жильцов - вряд ли. Вас отдубасят всевозможнейшими штрафами, задавят судебными издержками, гонорарами юристов и выкинут на улицу без штанов в течение трех-четырех месяцев. Потом вашу квартиру успешно сдадут в рент, будут получать приличную прибыль. Но чтоб вы не дай Б-г не вьехали обратно, ассосоциация позаботится о том чоб ваш долг не сокращался а наоборот, увеличивался. Поэтому штрафу будут идти еще больше что рент не покрыл ваш долг. Это если у вас моргадже. Если вы счастливый обладатель выплаченного жилья и не мазохист который не платит ассессмент потому что любит судится и жаждет оказаться на улице - то тут все хуже. Такой лакомый кусочек ассоциация не упустит и продаст ваш 50-60-70-и больше тысячную недвижимость на те копейки что вы должны (скажем, 5 тыс накрутили вам) - тому кто первый даст оффер. Скорее всего это случайно будет один из родственников/знакомых Совета Директоров.
То что я довиваюсь - полного запрета продажи чужой недвижимости ассоциациями жильцов. А также ограничения их полномочий, обязательную медиацию и уменьшение штрафов до $25.00. Сейчас некоторые деятели берут до $100 и выше. Прозрачность документации и поквартальный аудит расходов. Почему есть Фуд и Драг Администратион? Жилье не может быть отдано на откуп штатам и ассоциациям соседей.
Пока мы этого не добьемся - они так и будут гнобить владельцев жилья в сложной фин. ситуации. Под Дедов Интернационал.
