Чи реально получить грінкарту нелегалу, якщо він женится на особі у якої є грінкарта?. Чи тільки американський паспорт потрібний?

Вполне реально, только не сразу, прийдется ждать пока дадут immigration visa number, раныше это было около 5 лет теперь намного быстрее или когда жена станет citizen то тогда легализация происходит совсем просто и быстро: с момента подачи I-485 у Вас уже легальный статус: ждете грин карту.

Вполне нереально. Если ты нелегал, то владелец грин карты тебя не может легализовать вне зависимости от очереди. Эта привилегия есть только у граждан. Учи мат. часть, Алекс.

Аноним, ссылочку можно на закон который говорит что если супруг грин кард холдэра нелегал то нельзя его спонсировать ?

А значит если супруг гражданин или гражданка то так и написано что не обязательно быть "легальным" ?

Конечно написано! Ты удивишься!Посмотри INA: ACT 245 - ADJUSTMENT OF STATUS OF NONIMMIGRANT TO THAT OF PERSON ADMITTED FOR PERMANENT RESIDENCE
Sec 245 (c)(2) гласит:
Other than an alien having an approved petition for classification as a VAWA self-petitioner, 1aa/ subsection (a) shall not be applicable to 1/ subject to subsection (k), an alien (other than an immediate relative as defined in section 201(b) or a special immigrant described in section 101(a)(27)(H) , (I) , (J) , or (K) ) who hereafter continues in or accepts unauthorized employment prior to filing an application for adjustment of status or who is in unlawful immigration status on the date of filing the application for adjustment of status or who has failed (other than through no fault of his own or for technical reasons) to maintain continuously a lawful status since entry into the United States;
А 201(b) пункт указывет, что это Aliens Not Subject to Direct Numerical Limitations. Супруги грин карт к таковым не относятся поэтому только женившись на гражданине нелегал сможет легализоваться.

На практике супругов постоянных жителей США не депортируют, не слышал чтобы петицию на супруга от грин кард холдэра отказали на том основании что тот на кого подают - нелегал. Они же понимают что рано или поздно супруг станет гражданином и легализует своего spouse.

Spouse Of A LPR
As a Lawful Permanent Resident (LPR) you have a slightly
different process than that of a U. S. citizen. The first
step is to file the I-130 Petition for Alien Relative with
USCIS. Once that is approved, you must wait until a
visa is available for your spouse to file for the green
card. You can determine when a visa is available by
looking at the Visa Bulletin. If your spouse is in the
United States and is in lawful status, they can file for
the adjustment of status here in the United States.
Otherwise the approval will be sent to the National Visa
Center (NVC).
The process at this point is the same as it was described for
the spouse of a U. S. citizen. There is, however, one
danger for the spouse of a LPR that spouses of U. S.
citizens do not have to worry about: retrogression.
Retrogression occurs when the demand for visas is
higher than the visa availability and the visa availability
date can go farther back in time. This is one of the
many good reasons to keep an eye on the Visa Bulletin.
