Кто знает подскажите. Как подсчитывают алименты на ребёнка в штате Илинойс? Ситуация: мужчина имеет дочь 8 лет, на её маме женат не был, но признал отцовство. Сейчас платит ей в месяц по 300$ плюс страховку на здоровье (200$ выходит). Мама решила подать на алименты, так как ей кажется, что она может получить больше через суд. Зарплата у мужчины по разному, зависит от того, сколько часов наработает, в год выходит около 40000$. Права ли мама, что через суд она получит больше?

Child Support - Child support is generally ordered by the court in situations in which a child lives with one but not both parents. The non-custodial parent, or the parent with whom the child does not live, is responsible for contributing a certain portion of his or her income, based on state child support guidelines, to help support the child, even if the custodial parent has income of his or her own. All states, including Illinois, have guidelines by which courts determine child support. The guidelines were originally established because variations in the amounts of support set in similar circumstances were considered to be too wide and because child support, in many cases, was considered to be too low. The guidelines are formulas that consider the income of the parties, the number of children, and other factors. Child support guidelines attempt to approximate the proportion of parental income that would have been spent for support of the child if the family had not been divided by divorce. Courts plug numbers into the formula and come up with an amount of support that should be paid for the child or children. The child support guidelines are not the exact method of calculating child support in every situation, and parties can argue that because of special circumstances, a court should order more or less support than the guideline amount.

Child Support in Illinois
Illinois has guidelines for child support that are presumed to be in the child's best interest. Unless both parents agree to an amount other than that calculated using the guidelines, child support will be based on the guidelines as a percentage of the parent who will pay the support's net income (take home pay).

The above guidelines were intended to be the minimum amount of support to be paid, but the court routinely enforce the stated percentage amount with few variances. A variance from the guidelines -- greater of lesser -- is permitted under the law, but the court must make a specific finding that applying the guidelines would not be appropriate.

In the above table, "net income" means gross income from all sources less taxes (federal, state and social security), required retirement contributions (this apples mostly to school teachers), union dues, health insurance premiums, prior obligations of support, and a few other specific deductions. The statute applies to "all income from all sources" and that is about as plain a set of words as can be found in any statute. Still, many divorced parents often are not sure whether they're entitled to, or obligated to pay, child support from certain sources of income.

A non-custodial parent may be required to pay for a part of a child's day care expenses to enable the custodial parent to earn a living. Such payments are over and above regular child support payments

Non-custodial parents usually are required to provide health insurance for the minor children if the insurance can be obtained through the non-custodial parent's employment. If so, the cost of the health insurance may be deducted from the payer's gross income as a deduction (like taxes before making the child support calculation.
