There are several ways you can get out, one of them being the mortgage contingency provision, attorney approval/modification, and professional inspection provisions. Need to see whether builder is in breach or not. If you're buying a new house, the odds are against you because the contract is usually not a standard form contract but is drafted to protect mostly the builder. I'd have to see the contract and ask a few questions to really answer your question.
